Definitions

 

 

GCC                            Means  the  COOPERATION  COUNCIL  FOR  THE  ARAB STATES  OF  THE  GULF,  hereinafter  called  GCC,  with  its members  the  United  Arab  Emirates,  Sultanate  of  Oman, Kingdom of Saudi Arabia, Kingdom of Bahrain, State of Qatar and the State of Kuwait who each signed the GCC Charter

at Abu Dhabi City, United Arab Emirates, on 21 Rajab 1401, corresponding to 25 May 1981.

 

GCC waters             Means the territorial sea of GCC member states and all GCC internal  waters  and  the  Economic  Zone  as  defined  in  the International Law of the Sea.

 

Government              Means the Government of a state being a member of the GCC.

 

Minister                  Means minister responsible for ports or maritime transportation.

 

Competent or designated authorities        Means    the    port    authorities    and    other    organisations designated  by  a  Government  of  a  GCC  member  state  to process information reported pursuant to these regulations.

 

Activity list              In respect of ports, means the part of Schedule 2 particular to that ports, subject to changes shown in a port authoritys website.

 

Agent (Ship)            Means any person mandated to supply information and act on behalf of the owner or operator of the ship and holding a valid license from a port authority.

 

Codes                     Means the Codes relevant to ports or shipping issued by the IMO  or  ILO,  or  both,  or  any  regional  Code  relevant  to  the protection of the environment.

 

Conventions            Means the Conventions relevant to port or shipping, or both, issued by the IMO, ILO or the Regional Conventions related

to the protection of the environment.

Employee                 Means a person employed by an employer.

 

Employer                 Means a person who employs one or more employees.

 

ILO                       Means the International Labour Organisation, Geneva.

 

 IMO                      Means the International Maritime Organisation, London

 

License                   Means a right issued by the port authority as licensor for the licensee to perform services or works in, at or for that port.

 

Licensed pilot          Means a person who holds a valid licence as a pilot issued by a competent port authority in a GCC member state under these regulations.

 

Master                    Means  a  ship  officer  who  is  competent  and  licensed  to command and duly assigned by the ship owner to account for a ship.

 

Measure (s)               I.e.  dimensions,  weights,  masses,  volumes,  temperatures, speed  etc.  shall  refer  to  the  decimal,  respectively  metric system.

 

Riyadh Memorandum of Understanding (MOU)         Means   the   joining   of   GCC   States   sharing   common waters  under  an  accord  called:  Riyadh  Memorandum  of Understanding (Riyadh MOU), ensuring  that vessels trading in their area are not substandard.

 

PERSGA                   Means The Regional Organisation for the Conservation of the Environment of the Red Sea and Gulf of Aden (PERSGA).

 

Person                      Includes   a   partnership,   an   association   and   a   body corporate.

 

Port                          Means a port designated in Schedule 1: Schedule of Ports in these regulations.

 

Port authority            means  the  Governments  competent  port  authority  or  the agency  or  body  corporate  designated  by  a  Government, or  designated  authority,  by  way  of  decision,  act,  decree, concession or other legal instrument to control, manage or ad a port or group of ports under these regulations within the defined boundaries.

 

Regulations               Means the “Regulations for Ports in the Gulf Co-operation Council Member States”.

 

Ship/Vessel               It  is  any  watercraft  liable  to  move  ,  steer  and  do  normal navigation as usual

 

ROPME                    Means  the  Regional  Organisation  for  Protection  of  the Marine Environment.
